1. Definitions

"So Fetch", "we", "us", or "our" refers to the company SOFETCH LTD.

“Application” refers to the So Fetch applications, available both on Android and iOS.

"User", “customer”, "you", or "your" refers to the person using the So Fetch applications.

"Errand Runner", or “runner” refers to the individual performing the requested errand on So Fetch applications.

“Terms” refers to these terms and conditions, as updated from time to time.

2. Account Registration

2.1 Account Creation

a) You must create a So Fetch account before placing an order.

b) You must be at least 18 years old to create an account.

c) You must use a secure and unique password, and we may require you to provide your credit card details.

d) It is your responsibility to provide accurate, current, and complete information during registration.

2.2 Account Security

a) You are responsible for maintaining the confidentiality of your account and password.

b) You are liable for any orders placed through your account, even if used by another person, unless the breach was due to our failure to secure your password.

2.3 Account Closure

a) You have the option to close your account at any time via the Application or by reaching out to us directly.

b) We reserve the right to suspend or permanently terminate your account:

·      If we suspect unauthorized use of your account.

·      If you misuse our services (for example, by making excessive or unreasonable complaints, mistreating our staff, or ordering hazardous items).

·      If you fail to provide requested information in a timely manner.

·      If we suspect any fraudulent or criminal activity.

·      If continuing the service could potentially violate relevant laws or regulations.

2.4 Verification and Information Requests

a) So Fetch reserves the right to verify customer and runners’ identity, age, and other relevant details.

b) We may request additional information when reasonably required.

2.5 Privacy

All customer information will be handled in accordance with our Privacy Policy.

3. Use of Services

3.1 So Fetch provides a platform connecting Users with Errand Runners for various tasks.

3.2 You must be aged 18 or older to use our service. By placing an order through our Application, you confirm that you are aged 18 or older.

3.3 You agree to use the service only for lawful purposes and in accordance with these Terms.

3.4 So Fetch reserves the right to refuse service to anyone for any reason at any time.

4. Service Availabilities

4.1 Delivery Areas

a) Each runner has a prescribed delivery area.

b) Delivery areas may change at any time due to factors such as weather conditions, traffic, or demand on our application.

4.2 Runner Availability

a) Our runners independently determine their own working hours.

b) The availability of our service and the range of runners from which you can place orders depends on the availability of runners in your area at any given time.

4.3 Service Limitations

a) If you attempt to place an errand-running order to a location outside the current delivery area, we will notify you that the order cannot be completed.

b) If you try to place an order outside the working hours of available runners, the application will inform you that service is not available at that time.

4.4 Application Availability

a) We strive to maintain high availability of our application, but there may be times when it is unavailable due to maintenance, technical issues, or other reasons beyond our control.

b) In the event of application unavailability, we will make reasonable efforts to restore service as quickly as possible.

4.5 Notifications

a) We will notify you through the application if placing an order is not possible due to any of the above reasons.

b) Where feasible, we will provide estimated timeframes for service restoration or suggestions for alternative options.

5. User Responsibilities

5.1 You are responsible for the accuracy of the errand details you provide.

5.2 You agree to pay the fees associated with the services as outlined in the app, even if you have placed the order for someone else.

5.3 You will treat our runners with respect and not engage in any abusive, threatening, or inappropriate behavior.

6. Age-Restricted and Regulated Products

6.1 Age Verification for Restricted Products

a) Age-restricted products (including, but not limited to, alcohol, tobacco, and cigarettes) can only be purchased and delivered to individuals aged 18 or over.

b) By requesting an errand involving age-restricted products, you confirm that you are at least 18 years old.

c) So Fetch operates an age verification policy. Runners will ask customers to provide proof of being 18 or older before completing deliveries of age-restricted items.

d) Runners may refuse to deliver any age-restricted product if valid photo ID proving the recipient is 18 or over cannot be provided.

6.2 Alcohol-Related Errands

a) Runners may refuse to deliver alcohol to any person who is, or appears to be, under the influence of alcohol or drugs.

b) Orders for items containing alcohol may only be delivered to residential or business addresses.

6.3 Regulated Products

a) Certain errands may involve the purchase of regulated products, such as over-the-counter medicines. These products are sold by third-party vendors, not by So Fetch.

b) So Fetch is not held liable for any liabilities regarding users’ orders.

6.4 Refusal of Delivery

If delivery of any age-restricted product is refused due to failure to provide adequate age verification, you will still be charged for the item and the errand service.

6.5 By using our service for errands involving age-restricted or regulated products, you agree to comply with all applicable laws and regulations.

7. Prices and Payments

7.1 Expected Delivery Fees

a) Our service fees are displayed in the app and may vary based on factors including distance, runner availability, and task complexity.

b) A Minimum Distance Charge applies to orders under 2 miles to ensure viability of short trips.

7.2 Payment Methods

a) Payments can be made via the Application using credit/debit cards, Apple Pay (for iOS users), Alipay, or other methods made available by So Fetch.

b) By placing an order, you agree to pay all associated fees using the provided payment methods.

 7.3 Payment Processing

a) Upon order confirmation, your credit/debit card will be authorised for the total amount.

b) The marked amount will be charged once the order is completed.

 7.4 Cancellations and Refunds

Cancellations can only be processed by contacting customer support. Customers have a 3-minute window to cancel after a runner accepts the order. Cancellations after the 3-minute window are non-refundable and may incur cancellation fees.

8. Tips

8.1 When you place an order on our Application, you will have the option to add a tip to your runner, in addition to the expected delivery fee for your order.

8.2 Once you have received your order, you will have another chance to pay a tip to your rider.

8.3 We will collect payment on behalf of the rider, as their limited payment collection agent, and payment of the tips shall be considered a direct payment from you to the runner.

8.4 Depending on the payment method used for your original order, your tip may show up on your bank/credit card statement as a separate payment.

8.5 Tips are non-refundable and your rider will receive 100% of any payment you choose to make.

9. Privacy and Data Protection

9.1 We collect and process your personal data in accordance with our Privacy Policy, which is compliant with the General Data Protection Regulation (GDPR).

9.2 By using So Fetch, you consent to the collection and use of your information as described in our Privacy Policy.

10. Limitation of Liability

10.1 Scope of Our Liability

a) So Fetch is liable only for foreseeable losses or damages directly resulting from our breach of these Terms or our failure to exercise reasonable care and skill in providing our services.

b) "Foreseeable" losses are those that are obvious or that you inform us about prior to placing an order.

10.2 Non-Excludable Liabilities

So Fetch does not limit or exclude liability where it would be unlawful to do so, including:

a) Death or personal injury caused by our negligence

b) Fraud or fraudulent misrepresentation.

c) Breach of statutory implied terms about title to goods

d) Breach of your legal rights relating to the Items.

e) Defective products under the Consumer Protection Act 1987.

10.3 Exclusions of Liability

So Fetch is not responsible for:

a) Any liabilities, losses, or damages arising from the items ordered by you or the decisions made regarding those items.

b) Losses or damages resulting from your own breach of these Terms.

c) IT hardware or software failures not related to our Application.

d) The quality of services provided by Errand Runners.

e) Any indirect, incidental, special, consequential, or punitive damages.

10.4 By using our service, you acknowledge and agree that So Fetch is not liable for any issues arising from the products purchased or delivered at your request.

11. Intellectual Property

All content and functionality on the So Fetch app is the exclusive property of So Fetch and protected by copyright laws.

 12. Termination

We reserve the right to terminate or suspend your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Application.

14. Governing Law

These Terms are governed by English law, and you can bring legal proceedings in relation to our Service in the English courts.
